A Lapeer County jury returned a no-cause verdict in favor of a bar in a Dram Shop Act claim on October 6, 2017. Plaintiff and the Allegedly Intoxicated Person (“AIP”) were patrons of the social establishment on June 7, 2015. The two were involved in a fight in the parking lot after closing and Plaintiff sued for Assault & Battery as well as liability under the Dram Shop Act alleging the bar served the AIP while he was visibly intoxicated. Plaintiff sought damages in excess of $1 million dollars for current and future pain and suffering.
The Defendant bar, represented by Collins Einhorn Farrell PC attorney Karen R. Geibel, argued that the Plaintiff’s injuries were caused by his own gross intoxication and there was no evidence regarding over-service of alcohol at the establishment. After less than two hours of deliberation, the jury agreed finding no liability under the Act.
