Amy L. Felder

Amy routinely represents insurance companies throughout the United States in a wide variety of complex first- and third-party insurance coverage disputes. She provides guidance to clients in connection with coverage opinions and is active in litigating insurance claims in the areas of bodily injury, property damage, construction defects, toxic torts, product liability, first party property, auto and bad faith claims. Amy’s experience also includes counseling clients and litigating insurance coverage disputes in connection with CGL, personal lines, umbrella and excess policies. She has handled casualty/liability defense cases for Fortune 100 clients, general and commercial litigation.

Obtained summary disposition for insurance agent and agency in lawsuit brought by insured alleging bad faith, negligence, misrepresentation and intentional or negligent infliction of emotional distress. No “special relationship” was present that would require the agent or the agency to advise the insured about the adequacy of coverage. (Dec 2016)

Obtained summary disposition for insurer in dispute with homeowner with respect to water damage and resulting property damage due to a roof sag as a result of ice and snow. (Oct 2016)

Obtained summary disposition for insurer in dispute with homeowner as to whether water damage to basement was covered under homeowners’ insurance policy which specifically excluded coverage for damage caused by flood. (Aug 2016)

Obtained summary judgment on behalf of insurance carrier for rescission of insurance policy due to insureds material misrepresentations on insurance application. (Dec 2009)

Served as coverage counsel for insurer with respect to hundreds of claims alleging exposure to defective drywall. (2008-2012)

Represented an environmental consulting company in a breach of contract for faulty certification of engineering work performed at a landfill, and won a motion to dismiss based on lack of personal jurisdiction. (2007)

Defended two national insurance companies against an automotive parts supplier where the supplier allegedly discharged massive amounts of a toxic chemical into city sewers allowing the chemical to freely enter a major river. Case favorably settled for the insurers on the eve of trial. (2003-2005)
