The Employment Practices Liability group at Collins, Einhorn, Farrell & Ulanoff has handled a wide range of employment related matters for more than 20 years. The steady growth of employee litigation and the more pervasive regulation of employers have increased the need for expert legal advice in navigating the myriad of challenges faced by today’s employer.

Collins, Einhorn, Farrell & Ulanoff defends employers in both state and federal courts on claims of wrongful discharge, discrimination, harassment and retaliation. We also defend employers against employment-related tort claims such as defamation, intentional interference with business relations, invasion of privacy and intentional infliction of emotional distress. Our litigation strategy is to focus on the prompt identification and development of legal defenses that may lead to summary dismissal of the case. The Employment Practices Liability group has an outstanding record of securing early dismissals. At the same time, we understand that thorough investigation is essential to employment litigation and will often lead to the discovery of factual defenses or methods of limiting plaintiff’s damages in the event the case proceeds to trial.

Our Employment Practices Liability group is also experienced in representing employers on discrimination/retaliation claims before administrative agencies such as the Equal Employment Opportunity Commission (EEOC) and the Michigan Department of Civil Rights (MDCR). We also handle unemployment claims before the Michigan Unemployment Agency and wage and hour claims before the Michigan Department of Labor and Economic Growth.

In addition to representing employers in adversarial proceedings, the Employment Practices Liability group advises employers on disciplinary matters and termination decisions with the goal of preventing litigation. We also assist employers with ongoing FMLA and wage and hour issues as well as draft/revise employee handbooks and provide EEO training to staff.

The Employment Practices Liability group at Collins Einhorn, Farrell & Ulanoff is headed by experienced attorneys Jan Hildenbrand and Deborah Lujan. They are supported by associate Jacqueline Bayley and the firm’s excellent appellate practice group. Jan Hildenbrand is the Michigan editor of the Defense Research Institute’s 2006 Employment Law, a State-by-State Compendium and the author of Quick Reference to the 2008/2009 FMLA Amendments for Employers.

Workers Compensation

Our Workers Compensation attorneys have over 50 years combined experience representing employers before magistrates throughout the state, the Appellate Commission, the Michigan Court of Appeals and the Michigan Supreme Court.  Utilizing recent developments in Michigan law to the advantage of our clients, we have advised clients about the strategic use of vocational assessments to defeat workers' disability claims.  Our attorneys have successfully tried over 100 workers compensation matters for insured and self-insured employers.  The Workers Compensation group is headed by Allen Wall and Kenneth Merritt.
