CEFU Lawyers Slank and Brown Obtain an Appellate Reversal in the Michigan Supreme Court

Geoff Brown and Noreen Slank secured an appellate reversal in the Michigan Supreme Court of an order denying their client’s motion for summary disposition in Hanna v Merlos. The plaintiff in this dental-malpractice case did not attach the statutorily required affidavit of merit to his complaint. Despite case law holding that the failure to do so requires dismissal, the trial court nevertheless refused to dismiss the case. The Court of Appeals agreed with the trial court. But the Supreme Court reversed the Court of Appeals and the trial court, and ordered the trial court to enter an order of summary disposition in favor of the firm’s client.
