Court of Appeals Affirms Summary Disposition

Geoff Brown and Theresa Asoklis successfully defended an appeal from a probate court order granting their client summary disposition in a legal malpractice case arising out of an intrafamily dispute over the family’s business dealings. The plaintiffs argued that our client represented certain family members and family trusts and thus should have told the plaintiffs about actions other family members took in the course of a real estate transaction. The Oakland County Probate Court ruled that the statute of limitations expired as to the claims against the attorney client because legal work the client had performed was not performed on behalf of the plaintiffs, and the real-estate transactions the plaintiffs based their lawsuit on occurred more than two years before plaintiffs filed their complaint. On January 19, 2010 , the Court of Appeals agreed with the probate court and affirmed summary disposition in our client’s favor.
