Donald Campbell Serves as an Expert Witness in Attorney Fee Dispute in Oakland County Circuit Court

CEFU attorney Donald Campbell recently served as an expert witness in a attorney fee dispute in Oakland County Circuit Court. He testified on behalf of an attorney claiming a right to be compensated under quantum meruit where the attorney was constructively discharged by the client. Originally, the client had a 1/3 contingency fee agreement. The client fought the claim alleging that attorney misconduct should result in forfeiture of any fee. The Court, citing with favor Donald Campbell’s expert testimony, found no misconduct and awarded more than $200k in fees in quantum meruit which was 3x the amount that would have been awarded under the original contingency fee agreement. The opposing expert was Professor Lawrence Dubin.
