Sullivan Obtains Summary Disposition in Legal Malpractice Suit

Mike Sullivan recently obtained summary disposition on behalf of his lawyer client who was sued arising out of actions he undertook as an arbitrator. Mike asserted arbitral immunity as a defense, and defeated plaintiff’s contention that they were suing the lawyer defendant not for actions taken as an arbitrator (which they characterized as decisional acts), but instead for actions taken outside the arbitration process. Mike was successful in convincing the trial court that there is no case in Michigan that has limited the scope of arbitral immunity in the manner suggested by the plaintiff.
