Collins Einhorn attorney Donald Campbell is quoted in Are ‘Value-Based Fees’ Ethical?’ in the June 17, 2013 issue of Michigan Lawyers Weekly. The article discusses Don’s take on “value-based” billing:
It is good for clients and lawyers to be able to freely contract for the performance of legal services in return for a fee that is neither illegal nor clearly excessive. … The reality is that value billing improves client choice of counsel.
Still, Don cautions that there is some risk in using value-based billing. Michigan’s Attorney Grievance Commission has opined that value-based billing is unethical, which means that attorneys using this approach may be subject to disciplinary action. “As unfounded as it may be,” Don states, “such a circumstance is still a consequence of being ‘out front’ on value billing.”
