Court Dismisses Legal Malpractice Claim

On July 22, 2015, Michael J. Sullivan, Trent B. Collier, and Jason M. Renner successfully obtained summary disposition in a legal malpractice action pending in Oakland County Circuit Court. The corporate-plaintiff brought an action for professional negligence, alleging that its attorney failed to conduct “due diligence” with respect to legal services provided in connection with a loan and mortgage agreement plaintiff entered into with another corporation and its owners. When the corporation and its owners defaulted on the loan, plaintiff looked to the attorney for recovery of more than $700,000 in damages. The court summarily dismissed plaintiff’s complaint, holding that all of the claims asserted were barred by the applicable statute of limitations.
