Attorneys Kari L. Melkonian and Fawzeih H. Daher obtain summary disposition in Wayne County Circuit Court on behalf of an insurance company in a claim arising out of an alleged violation of special titling requirements set forth in the Motor Vehicle Code. The plaintiff purchased a used vehicle as-is from a dealership. The dealership obtained the vehicle after it was sold at auction by the insurance company following an accident. Plaintiff alleged that before auctioning the vehicle, the insurance company was required to obtain a salvage tile as set forth in MCL 257.217c, which imposes special titling requirements when the estimated repair cost is a certain percentage of the pre-damaged actual cash value of the vehicle. Plaintiff also argued that she was entitled to attorney fees. The insurance company argued, among other things, that the vehicle didn’t meet the statutory salvage threshold; the Court agreed and dismissed plaintiff’s statutory violation claim, as well as claims of fraud, negligence and violation of the Michigan Consumer Protection Act.
