Attorneys Matthew S. LaBeau and Joshua M. Stapp recently defended a restaurant in a slip and fall case. The plaintiff was walking down an alley next to the restaurant when she slipped on what she believed was grease from a fryer left in the alleyway. Matt and Josh filed a motion for summary disposition on the basis that the condition was open and obvious and that the restaurant had complied with its duty to plaintiff as a licensee. The Court granted the motion on both grounds, dismissing the case entirely. The plaintiff was claiming significant damages after undergoing multiple spine surgeries after the incident.
