Brian has been at the forefront of legal issues affecting lawyers, judges, courts, businesses and insurers almost from the beginning of his legal career. He has litigated numerous court cases and disciplinary proceedings that have shaped Michigan law – with issues ranging from lawyers’ potential liability to clients for defamation, to judicial candidates’ free speech rights. He has defended many district and circuit courts throughout the state, including Michigan’s largest and most populous, against §1983 actions and similar claims. He also provides crisis management services to clients confronted with legal issues giving rise to unwelcome media attention. Brian has tried in excess of 100 cases to verdict. He continues to apply his considerable experience and expertise to complex professional malpractice, disciplinary, product liability, insurance coverage, and catastrophic personal injury litigation. Brian has also served as the President of the State Bar of Michigan.
Brian represented an attorney who obtained a multi-million dollar settlement in a product-liability action. Another law firm claimed that it contributed to the settlement and demanded a $550,000 share of the attorney’s $1.8 million fee. Brian defended the attorney against the law firm’s claim. Attorneys Brian D. Einhorn and Karen R. Geibel obtained summary disposition for their client in a legal-malpractice case. Brian and Karen successfully argued that the plaintiff’s claims were invalid because their client’s statements—the basis for the plaintiff’s malicious-prosecution claim—were made in a judicial proceeding and therefore absolutely privileged. They also argued that the plaintiff couldn’t pursue a legal-malpractice claim at all because there was no attorney-client relationship between the plaintiff and the defendant. The Wayne County Circuit Court agreed, dismissing all claims against Brian and Karen’s client.
